RECOVERING YOUR MEDICAL EXPENSES

Brooks Law Office Oct. 16, 2020

When you file a personal injury claim, you are asking the at fault person to compensate you for causing harm to you. Proving your injuries, or damages as they are referred to in the legal world, is one of the most important and challenging aspects of a personal injury case. An injured party can be compensated for physical, emotional, and financial damages.

The first step is to prove that you have been injured. Then, you have to prove how much the at fault party should pay. In the State of Georgia, you are asking the at fault person to compensate you at the end of your claim by negotiating a settlement or by a jury verdict.

If you have health insurance, you should use it to pay for your medical expenses. You can also use Medical Payments Coverage, or PIP as it is referred to in some states, to pay for your medical expenses if you have it. Medical Payment Coverage is an add on option to your auto insurance policy. If you do not have health insurance or Medical Payments Coverage, we can help you get medical treatment through a medical funding company.

Be prepared. The at fault driver’s insurance company may fight against, or deny, your physical damage claim. They may argue that your treatment was not necessary or unreasonably expensive.

Your medical records are one of the most important ways to prove your physical damages. They identify your injuries, what treatment you underwent, and what treatment you will need in the future to recover.

Your billing statements are just as important. They identify how much your past and future medical bills will cost you. You can be compensated for the following medical expenses:

  • Hospital bills

  • Doctor’s charges

  • X-rays, MRI’s, CT scans, EMG’s

  • Prescriptions

  • Over the counter medication and supplies

  • Medical equipment

  • Mileage

It is important to note that if your health insurance company, or a medical funding company, has paid any of your medical bills, they may be entitled to some of the money that you receive in a negotiated settlement of jury verdict.
