Motion for New Trial by State Farm.....DENIED

The Chatham County State Court has denied State Farm’s motion for new trial on a verdict rendered for a pick up truck owner damaged by a State Farm insured in 2014 who ran a red light. This insurance bad faith action involved cost of repair that State Farm has refused to pay. Insurance bad faith cases involving an insured at-fault driver requires two verdicts: first, a verdict against the insured policy holder for damages caused, and, secondly, a verdict against the insurance company for insurance bad faith. Based on the two verdicts rendered, the Court entered a $42,023 Judgment against State Farm and its insured. State Farm moved for a new trial in 2014. After considering the trial evidence and the motion and the briefs submitted by State Farm and the injured party, the Court denied State Farm’s motion. Interest continues to accrue on the judgment until its paid.
